Women Successfully Bring Maternity Discrimination Claims

A number of cases of maternity discrimination have featured in the media recently. 

In one such case, a woman brought a claim for sex discrimination against a large legal firm in Milton Keynes where she worked as a recruitment manager, reports the Daily Mail.

Bina Hale had been on maternity leave when she was notified by her employers that she had been selected for redundancy. The notes from the meeting where this decision had been taken were not available, and the credibility of her employers was questioned by the tribunal when they claimed they had been shredded because the HR Manager liked to work in a paper-free environment.

Ms Hale won her case and a further hearing is to take place to determine her financial award.

A second case also involved a woman who was notified of her selection for redundancy whilst on maternity leave.

Jenna Storrie worked as a financial controller for a large property firm in Glasgow, reports the BBC. During her maternity leave she was notified that a restructuring had taken place within the firm and her role was at risk of redundancy. She applied for a more senior position that had been newly created, but was unsuccessful and subsequently was made redundant.

She claimed that she had lost her job because she had been on maternity leave and the tribunal ruled in her favour, noting that her dismissal was automatically unfair because it breached Maternity and Parental Leave Regulations.

She was awarded just under £30,000, however her employer has indicated it intends to appeal against the decision.
